Senate Bill 2272 was signed into law and becomes effective October 2, 2010. This new law includes significant changes that will impact pain management clinics registered with the Department of Health. One of several limitations on ownership provides the following:
The Department shall deny or revoke the registration of any clinic that is not fully owned by a Florida licensed medical or osteopathic medical physician or a group of such physicians, or that is not a health care clinic licensed under part X of Chapter 400, Florida Statutes. (Chapter 400 Health Care Clinics are registered with the Agency for Health Care Administration (AHCA)).
If your clinic intends to meet this new ownership requirement by registering as a health care clinic with the Agency for Health Care Administration, you should do so now. If your clinic is not fully owned by a Florida medical or osteopathic medical physician or group of medical or osteopathic medical physicians, your clinic must be registered with AHCA by October 1, 2010 and if you do not meet these requirements the law directs the Department to revoke your clinic's registration. This new ownership requirement applies as well to new pain clinic registration applications submitted to the Department on or after October 1, 2010.
